The Florida Department of Highway Safety and Motor Vehicles issued updated guidance on Wednesday for beneficiaries of Temporary Protected Status (TPS) for Haiti.
The Secretary of Homeland Security had moved to end TPS for Haitians in early February. But U.S. District Judge Ana Reyes granted the plaintiffs’ motion to stop the termination. The lawsuit argued that the Trump Administration’s decision to end TPS for Haitians was driven by bigotry, and it pointed to Trump’s own comments about Haitians as evidence. The administration is expected to appeal the decision to the Supreme Court.
In the meantime, Haitian TPS beneficiaries who present qualifying documentation remain eligible for services through March 15, 2026, the office of Miami-Dade Tax Collector Dariel Fernandez said.
This applies to TPS beneficiaries with an expired Employment Authorization Document (EAD) with category A12 or C19, and/or an approved I-821 with the following expiration dates:
- Feb. 3, 2026
- Aug. 3, 2025
- Aug. 3, 2024
- June 30, 2024
- Feb. 3, 2023
- Dec. 31, 2022
- Oct. 4, 2021
- Jan. 4, 2021
- Jan. 2, 2020
- July 22, 2019
- Jan. 22, 2018
- July 22, 2017
“Individuals seeking issuance beyond that date must provide alternative proof of lawful presence, consistent with the advisory,” the tax collector’s office said. “The Miami-Dade County Tax Collector’s Office is assisting eligible individuals in full compliance with the official state directive. Residents are encouraged to review Technical Advisory DL 26-003 and consult the U.S. Citizenship and Immigration Services website for the most current federal guidance regarding TPS eligibility and documentation requirements.”
