A substitute teacher in Broward County was arrested for allegedly sexually assaulting one student and is accused of trying to engage in sexual acts with a second student, according to a new arrest report.
Marsel Javaris Smith, 27, was arrested Friday on charges including an authority figure soliciting or engaging in a romantic relationship with a student and sexual assault on a 16 or 17-year-old victim, records showed.
According to the report, Broward Sheriff’s Office Special Victims Unit investigators responded to Northeast High School in Oakland Park on Friday after a juvenile victim reported ongoing sexual conduct involving a Broward substitute teacher that began in October 2025.
The teacher was identified as Smith, who has worked for Broward Schools for about 3 years, the report said.
The student said on Oct. 1, she was walking on campus after dismissal when she was approached by Smith, who complimented her and asked for her phone number, the report said.
She said she gave him her number and they started exchanging text messages.
In one text Smith asked to see her and she declined, before he asked her to send him photos of herself, the report said.
“Dang you making wanna see more videos and pics but a lil more you know exclusive,” he texted her, according to the report.
Smith later texted her again to send him photos of herself and wrote “Trust me everything stays here between us,” the report said.
She declined and he responded, “But come on think of everything I be at your school. You can trust me,” the report said.
On Oct. 14, Smith texted her and she responded that she was at a fast food restaurant waiting for her grandma, and he went to the restaurant then asked her to perform a sex act on him but she declined, the report said.
After Smith left he texted her asking to see her and do sexual acts and told her they could have sex at the school, the report said.
Then, on Oct. 19, they were texting and Smith asked if he could pick her up, then picked her up and brought her to Oswald Park on Northwest 21st Avenue in Fort Lauderdale, the report said.
She said they were sitting in the back seat of his car when he requested she perform a sex act on him, and she said no but he pulled down his pants and grabbed the back of her head and had her perform a sex act on him, the report said.
The girl said she told him “no” multiple times but he wanted to have sex with her which they did before he dropped her back off at the home where she was staying, the report said.
She said Smith contacted her multiple times asking to see her but she avoided him at school, the report said.
Then, on Friday, the girl said she was walking in the hallway when she saw Smith, who approached her, asked to speak with her and made a comment about her hair, the report said.
She said Smith asked her to go with him to an empty classroom but she declined then reported him to a school security officer, the report said.
Investigators spoke with Smith who confirmed he exchanged contact information with the student and had seen her at a fast food restaurant, the report said.
When asked if he picked her up and brought her to a park Smith said he was “unable to remember” and ended the interview, the report said.
While investigating the allegations, detectives were made aware of a second juvenile victim who reported that in 2025, while Smith was a substitute for her class, he had asked for her number and texted her requesting she perform a sex act on him, the report said.
The investigation into that allegation is ongoing, the report said.
Smith, who lives in Pompano Beach, was booked into jail and on Saturday appeared before a judge, who set his bond at $30,000 and ordered him not to have contact with minors.
Northeast High School parents and families received a message on Friday informing them of the arrest.
“An individual who is not a Broward County Public Schools employee but worked as a substitute teacher through Kelly Education was arrested today, Friday, April 24, accused of sexual misconduct with a student. We are deeply disturbed by the allegations and are working closely with the Broward Sheriff’s Office regarding this matter,” the message read. “I am not able provide additional details due to the ongoing investigation. However, please be aware that this individual is no longer permitted to work as a substitute teacher anywhere in Broward County Public Schools.”
