A judge denied the Miami-Dade State Attorney’s request to prohibit the dissemination of a Florida Department of Law Enforcement report from being released to the public following a legal challenge by NBC6, Telemundo 51 and the Miami Herald.
The legal challenge stemmed from an FDLE report on Pinecrest police officer Andres Garcia, who records showed fired his weapon during a confrontation in July 2025.
Records show police received a call of an intersection takeover at South Dixie Highway and Southwest 104th Street involving about 30 dirt bikes and all-terrain vehicles. Additionally, eight vehicles were parked at the Mobil Gas Station at 10345 South Dixie Highway.
When the police officers, including Garcia, arrived at the gas station, the all-terrain vehicles started fleeing.
Police chase
Police records show that Garcia parked near an off-road vehicle being driven by Adolfo Denis, which was parked near a gas pump.
As the officer began to open his driver’s side door, Denis accelerated towards the officer’s vehicle, allegedly hitting the officer in the leg, and then speeding off.
At the same time, Garcia shot Denis’s vehicle multiple times, according to records obtained by NBC6.
Denis allegedly sped down Krome Avenue and led police on a chase of more than 20 miles, until officers conducted a PIT maneuver and detained him and other suspects.

Denis has since been charged with battery on a law enforcement officer, leaving the scene of a crash and fleeing and eluding, among other charges. State attorneys ended up dropping an attempting murder on a law enforcement charge he initially faced.
As Denis awaits trial under house arrest, a new FDLE report was recently provided to defense attorneys regarding Garcia’s use of force.
Records now reveal Garcia is under investigation by the Miami-Dade State Attorney’s Office regarding the “non-contact police involved shooting.”
Despite providing the FDLE report to defense attorneys, prosecutors tried to convince Judge Tanya Brinkley on Wednesday that she should prevent the report from being released to the public.
On April 10, the state attorneys denied NBC6 from obtaining the FDLE report in a public records request, citing the pending motion on keeping it sealed.
On Wednesday, an attorney representing NBCUniversal and The McClatchy Company, the Miami Herald’s publisher, appeared in court to intervene.
“Any documents that are shared with the defendant are required under the law to be shared with the public or required to be produced with the public records request,” said Daniela Abratt-Cohen, an attorney in court on behalf of NBC and the Miami Herald.
State attorney Andres Perez told the judge Wednesday that Garcia was under investigation and the findings would be “forthcoming,” providing no exact timeline.
“Once FDLE transmitted the report to our office, our office then conducts an investigation into the non-contact shooting and then will make a determination into what they want to do with the officer,” Perez said.
At the end, Judge Brinkley understood the state had an active investigation but believed it was not a good enough reason to prohibit the report from being released to the public.

After the hearing, NBC6 obtained the FDLE report, which revealed Garcia fired about nine shots at the gas station.
Records show Denis’s off-road vehicle had multiple bullet holes, including three possible entry marks on the driver’s side front and rear doors.
At the time, Garcia advised through dispatch, “shots fired, shots fired,” followed by “I got hurt, shots fired.”
However, a sergeant mentioned in the report that Garcia was not shot but sustained an injury to his left foot after being allegedly run over by Denis. Records show Garcia did not fracture or break his leg.
It’s unclear if state attorneys will file charges against Garcia for his use of force.
NBC6 reached out to the South Florida Police Benevolent Association, which is representing him legally per records, but we haven’t heard back.
Denis has pleaded not guilty.
