The complaint alleges Hocking “unlawfully, with malice aforethought, murder the victim, his wife,” prosecutors said.
The fatal shooting was reported around 12:20 a.m. Saturday in the 5000 block of Mowry Avenue, not far from the couple’s Fremont home. When officers arrived at the scene, they found Hocking standing by his vehicle and his wife in the front passenger seat, according to the Fremont Police Department.
“The victim presented with a physical injury and was pronounced deceased at the scene,” police said.
Officers also recovered a firearm inside the vehicle.
Hocking is set to be arraigned at 9 a.m. Tuesday at the East County Hall of Justice in Dublin. He is in custody at Santa Rita Jail on a no bail hold.
